Topic: The
presentation will cover two significant and related changes to the commercial
landscape: the FTC’s negative option rule and emerging rules against so-called
“dark patterns.” The negative option rule imposes strong transparency and
agreement requirements on recurring orders of good and services. The dark
patterns rules forbid the use of deceptive or coercive user interface design to
obtain consent or agreement.
Presenter: Dustin Berger
Dustin Berger is an attorney in Dorsey & Whitney’s tech commerce practice.
His practice centers on technology, data security, and data privacy. He is
recognized by the International Association of Privacy Professionals as a
Fellow of Information Privacy, Certified Information Privacy Professional for
the United States, Europe, and Canada, Certified Information Privacy Manager,
and Certified Information Privacy Technologist. He also hold the Certified
Information Systems Security Professional (CISSP) designation from ISC2.
